Terms of Service — Smart Walk

1) About Us

These Terms govern your use of smartwalk.shop (the “Site”) and purchases from Smart Walk (“we,” “us,” “our”). We are based in Slovenia and currently sell and ship to the United States only.

2) Online Store Terms

By using the Site and placing an order, you represent that you are at least 18 years old (or the age of majority in your state) and will use our products lawfully and as intended.

3) Product Information & Safety

Leashes and related products must be used responsibly and under adult supervision. Always inspect products before use. You are responsible for selecting suitable products for your pet’s size, strength, and behavior. Misuse can cause injury. Follow all care and use instructions.

4) Ordering, Acceptance & Cancellation

Your order is an offer to buy. We may accept or decline any order (e.g., for suspected fraud, pricing/stock errors). If we cancel after charging you, we will issue a full refund. Requests to change/cancel orders must be received immediately after purchase; we cannot guarantee changes once processing begins.

5) Pricing, Taxes & Duties

Prices are shown in USD and may change without notice. Applicable sales taxes are collected at checkout when required. Orders ship internationally; any import duties/taxes assessed on entry to the U.S. (if applicable) are the customer’s responsibility.

6) Shipping & Delivery

We ship from overseas fulfillment centers (primarily China). Typical U.S. delivery is 10–25 business days. Delivery times are estimates and not guaranteed. We are not liable for delays outside our control (customs, carrier issues, weather, peak seasons). Risk of loss transfers upon delivery to the shipping address you provided.

7) Dropshipping & Third-Party Fulfillment

We may source, store, and ship products via third-party suppliers. By ordering, you consent to your order being fulfilled and shipped by third parties on our behalf, including direct shipments from outside the U.S.

8) Returns & Refunds

Please review our Refund Policy (above) which is incorporated into these Terms. In brief: returns are accepted only for defective/damaged/incorrect items with prior authorization; customers cover return shipping unless otherwise stated.

9) Intellectual Property

All content on the Site—text, graphics, logos, images, and trademarks—is owned by or licensed to Smart Walk and protected by law. You may not use, copy, or distribute it without our prior written consent.

10) User Content (Reviews, Photos)

If you submit reviews, images, or comments, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for marketing, store listings, and social media, subject to applicable laws and platform rules.

11) Prohibited Uses

You agree not to use the Site for any unlawful purpose; to solicit others to perform unlawful acts; to violate any international, federal, state, or local regulations; to infringe intellectual property rights; to harass, abuse, defame, or discriminate; to upload malicious code; or to interfere with security features.

12) Warranties & Disclaimers

Except as expressly stated, the Site and products are provided “as is” and “as available.” We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow limitations on implied warranties, so the above may not apply to you.

13) Limitation of Liability

To the maximum extent permitted by law, Smart Walk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Site or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

14) Indemnification

You agree to indemnify and hold Smart Walk harmless from any claim arising out of your breach of these Terms or misuse of our products or Site.

15) Governing Law & Disputes

These Terms are governed by the laws of Slovenia, without regard to conflict-of-law rules, and the courts of Ljubljana, Slovenia shall have exclusive jurisdiction, except where consumer protection laws in your U.S. state provide you with additional mandatory rights.

16) Changes to the Terms

We may update these Terms at any time by posting a new version on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the new Terms.
